In today's landscape, education is changing all the time, especially with neurodivergent conditions on the increase. We aim to use this page to help in any way we can to encourage schools to provide the advice and support that they should be given.

Education, Health and Care Plan's (EHCP's)


Many children have EHCP's put in place at school to make sure that they are supported in the ways they need to be in order to receive the best education that they possibly can.


Unfortunately, there seem to be more and more cases of both schools and local authorities, either not providing or refusing to provide the noted, essential actions that are meant to be met by order of the EHCP.


We are here to tell you that this is ILLEGAL.


An EHCP is a legally enforceable document.


A local authority is bound by law to make sure that all provisions mentioned in an EHCP are met as it is their duty of care.


If this is the case for you, please follow these steps.


  1. Approach the SENCO worker at your child's school and mention your concerns.


2. If the SENCO does not provide you with a reasonable answer to your concerns, request a meeting with the headteacher.


3. If the reasons given are financial, in that, the school cannot provided the care needed due to financial constraint, you need to contact the education department of your local authority.


4. If the case worker from the local authority doesn't reply within 28 days, make an official complaint. This complaint should be dealt with within 28 days. DO NOT allow the case worker to tell you that 'it's tough'. Or that it's 'that or home-schooling' as this is illegal.


5. If either they don't respond within the 28 days or they tell you 'it's tough'. You can use the letter below to give to the case worker and their Director of Education Services for the local authority.

This is a pre-action protocol letter which will let them them know that you would like to take the case to judicial review if they don't change their mind. THEY WILL NOT LIKE THIS.

Please note that it is also illegal for a school to suspended or exclude a child if all EHCP action points are not being taken.
